User Agreement

FOLLOWING DESCRIBES THE TERMS ON WHICH" EdServ Softsystems Limited. " OFFERS YOU ACCESS TO ITS
2TION.COM WEBSITE.
EdServ Softsystems Limited. is committed to providing you with the best online services. This Agreement
describes the terms and conditions applicable to your use of our services
available under the domain and sub-domains of
www.2tion.com (the “Site”); it does
not apply to other online or offline" EdServ Softsystems Limited. " sites, products or services. If
you do not agree to the terms and conditions of this User Agreement, do not use
our services. You must read, agree with, and accept all of the terms and
conditions contained in this User Agreement and the Privacy Policy, and those
terms and conditions that 2tion.com ("2tion", "this site", "we" or "our") may
revise at our sole discretion, by posting the amended terms on this site. We may
amend this Agreement at any time. All amended terms will be posted on the Site
and shall automatically be effective 30 days after they are initially posted on
the Site. This Agreement is effective upon acceptance in registration for new
registering users.
Membership Eligibility
Our services may only be used by individuals who can form legally binding
contracts under applicable law. If you are registering as a business entity, you
represent that you have the authority to bind the entity to this Agreement. Our
services are not available to suspended 2tion members. Persons under the age of
18 can use our services only in conjunction with, and under the supervision of
their parents or guardians.
Services and Fees
Registering as students (Tutor Requesters) and posting requests on 2tion.com is
free. We do charge fees for Tutors registration. You have the opportunity to
review and accept the fees that you will be charged. Our Fees are available in
the Help page. However, we may choose to temporarily change our fees for our
services for promotional events (for example, free first month services) and
such changes are effective when we post the temporary promotional event on the
Site." EdServ Softsystems Limited. " reserves the right to change some or all of our 2tion.com
services at any time." EdServ Softsystems Limited. " reserves the right to increase subscription fees
or to institute new fees at any time, upon a notice posted in advance on the
Site. Unless otherwise stated all fees are in U.S. Dollars. The Site acts as a
venue that allows anyone to offer services, post a request of a service, at
anytime, from anywhere. We are not involved in the actual transactions between
Tutors and Students (Service Requesters). As a result, we have no control over
the quality, legality, truth, accuracy of the services advertised and the
request postings made, the ability of the Tutors to provide services or the
ability of Service Requesters to pay for services. We cannot guarantee that a
Tutor or Service Requester will actually complete a transaction.
User Identity Verification
Because user identity verification on the Internet is difficult, 2tion.com
cannot and does not confirm each user's declared identity. Our user-initiated
feedback system helps you evaluate with whom you are dealing. We recommend that
you communicate directly with potential trading partners before making any
transaction.
Release
We are a venue, so in the event that you have a dispute with one or more users,
you release EdServ Softsystems Limited., 2tion.com(and our subsidiaries and employees) from claims,
demands and damages (actual and consequential) of every kind and nature, known
and unknown, suspected and unsuspected, disclosed and undisclosed, arising out
of or in any way connected with such disputes.
Information Discretion
We do not control the information provided by other users that is made available
through our system. You may find other user's information to be offensive,
harmful, inaccurate, or deceptive. Please use caution, common sense, and
practice safe trading when using the Site. Please note that there are also risks
of dealing with underage persons or people acting under false pretense.
Additionally, there may also be risks dealing with international trade and
foreign nationals. By using this Site, you agree to accept such risks and we are
not responsible for the acts or omissions of users on the Site.
Providing Service
As a Tutor you are obligated to complete the service requested by the Service
Requester Student) if the Service Requester has chosen you as the Tutor. You are
advised to contact the Service Requester prior to submitting your offer, to
eliminate all possible terms and conditions that would make you not fulfill the
requested transaction. By submitting an offer you agree to be bound by the
conditions of request of service included in the request's description as long
as those conditions are not in violation of this Agreement or unlawful.
Requesting Service
You must be legally able to request the services you post on the Site. You must
describe your request and all terms of service requested on the posting page of
the Site. Your posted requests may only include text descriptions, graphics,
pictures and other content relevant to the posting of that request. All posted
request must be posted in an appropriate category.
Provide accurate information
Information you provide is defined by any information you provide to us or other
users in the registration, offering or posting process, in any public message
area or through any email feature. You are solely responsible for your
information, and we act as a passive conduit for your online distribution and
publication of your information. Information you provide or any requests and
services you post on the Site shall not:(1) be false, inaccurate or misleading;
(2) be fraudulent;(3) infringe any third party's copyright, patent, trademark,
trade secret or other proprietary rights or rights of publicity or privacy; (4)
violate any law, statute, ordinance or regulation (including, but not limited
to, those governing export control, consumer protection, unfair competition,
antidiscrimination or false advertising);(5) be defamatory, trade libelous,
unlawfully threatening or unlawfully harassing; (6) be obscene or contain child
pornography; (7) contain any viruses or other computer programming routines that
may damage, detrimentally interfere with, intercept or expropriate any system,
data or personal information;(8) create liability for us or cause us to lose (in
whole or in part) the services of our ISPs or other suppliers;(9) link directly
or indirectly to or include descriptions of goods or services that: are
prohibited under this Agreement; You may not post any request on the Site (or
consummate any transaction that was initiated using our service) that could
cause us to violate any applicable law, statute, ordinance or regulation.
Neither you, Tutors nor Service Requesters Students) may manipulate the price
(offer) of any item nor may you interfere with other user's postings or
transactions. We may suspend or terminate your account if we suspect any,
without limiting to, any of the above. Enable us to use the information you
supply us with, so that we are not violating any rights you might have in that
information, you agree to grant us a non-exclusive, worldwide, perpetual,
irrevocable, royalty-free, sub licensable right to exercise the copyright,
publicity, and database rights (but no other rights) you have in your
information, in any media now known or not currently known. We will only use
your information in accordance with our Privacy Policy.
Information on the Site is proprietary or is licensed to" EdServ Softsystems Limited. " by our users
or third parties. You agree that you will not use any software or other
automated means to access the Site for any purpose without our express written
permission. You agree that you will not: (1) take any action that imposes, or
may impose in our sole discretion an unreasonable or disproportionately large
load on our infrastructure; (2) copy, reproduce, modify, create derivative works
from, distribute or publicly display any content (except for your information)
from the Site without the prior expressed written permission of" EdServ Softsystems Limited. " and the
appropriate third party, as applicable;(3) interfere or attempt to interfere
with the proper working of the Site or any activities conducted on the Site.
2tion.com Feedback service
You may not take any actions that may undermine the integrity of the feedback
system. You acknowledge that your feedback consists of comments left by other
users to you. Because feedback ratings are not designed for any purpose other
than for facilitating trading between this site users, you agree that you shall
not market or export your 2tion.com feedback rating in any other venue.
Breach
We may limit your activity, immediately remove your offers or request postings,
issue a warning to our community of your actions, suspend or terminate your
membership and refuse to provide our services to you if: (1) you breach this
Agreement or the documents it incorporates by reference;(2) we are unable to
verify or authenticate any information to us;(3) we believe that your actions
may cause financial loss or legal liability for you, our users or us.
Privacy
We do not sell or rent your personal information to third parties for their
marketing purposes without your explicit consent and we only use your
information as described in the Privacy Policy. If you object to your
information being transferred or used in this way please do not use our
services.
Disclaimer of Warranty
WE (INCLUDING BUT NOT LIMITED TO OTHER PARTY INVOLVED IN THE DESIGN, DEVELOPMENT
AND MAINTENANCE OF THE SITE), PROVIDE OUR SITE AND SERVICES "AS IS" AND WITHOUT
ANY WARRANTY OR CONDITION, EXPRESS, IMPLIED OR STATUTORY. WE INCLUDING BUT NOT
LIMITED TO OTHER PARTY INVOLVED IN THE DESIGN, DEVELOPMENT AND MAINTENANCE OF
THE SITE), SPECIFICALLY DISCLAIM ANY IMPLIED WARRANTIES OF TITLE,
MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
Liability Limit
IN NO EVENT SHALL WE, NOR OTHER PARTY INVOLVED IN THE DESIGN, DEVELOPMENT AND
MAINTENANCE OF THE SITE), BE LIABLE FOR LOST PROFITS OR ANY SPECIAL, INCIDENTAL
OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH OUR SITE, OUR
SERVICES OR THIS AGREEMENT (HOWEVER ARISING, INCLUDING NEGLIGENCE).
General
We do not guarantee that we will meet user's requirements. We do not guarantee
continuous, uninterrupted, secure access or error free operations to our
services. The operation of this Site may be interfered with by numerous factors
outside of our control. We make no warranty regarding any goods or services
purchased or received through the site, or any transactions entered through the
site. We are not responsible for any liability related to the completion and/or
payment for services or goods listed on our site. Any questions, complaints or
